A Study on Employer's Compensation Liability for Employee's Injury

The principle of liability fixation for employee's injury should adopt the fault liability of Article 35 of Tort Liability Law. At the same time, it should be amended on the basis of a rational analysis of the defects of Article 11 of Supreme Court's Judicial Interpretation and Law-application for Personal Injury Cases. And it should be in accordance with Article 35 of Tort Liability Law in order to perfect the provisions on employer's compensation liability for employee's injury.
