Abstract: According to the Article 129 of the Divisions of the Civil Code (Draft), the land contractual management right holders are entitled to transfer land management rights,which is in accordance with the Rural Land Contracting Law. This is the first time that China has made clear from the legislative level that the land management rights of farmers can be transferred. However, the legal issues related to the transfer of rural land management rights must be clear, and the relevant laws and regulations should be uniformly revised to build a legal system for the transfer of rural land management rights.
