雇主对雇员受害赔偿责任研究

A Study on Employer's Compensation Liability for Employee's Injury

  • 摘要: 雇主对雇员受害赔偿责任的归责原则应采《侵权责任法》第三十五条之过错责任。同时,应在理性分析《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》第十一条缺陷的基础上,对其予以修改,并与《侵权责任法》第三十五条契合,以期完善我国关于雇主对雇员受害赔偿责任之规定。

     

    Abstract: The principle of liability fixation for employee's injury should adopt the fault liability of Article 35 of Tort Liability Law. At the same time, it should be amended on the basis of a rational analysis of the defects of Article 11 of Supreme Court's Judicial Interpretation and Law-application for Personal Injury Cases. And it should be in accordance with Article 35 of Tort Liability Law in order to perfect the provisions on employer's compensation liability for employee's injury.
